Overview
Welcome to WEARON Clothing (“WEARON”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of our website, online store, content, features, tools, and related services (the “Services”). By visiting or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use or access the Services.
The Services are operated from the United Arab Emirates. Electronic records, contracts and signatures created via the Services are legally valid and enforceable under UAE law.
1. Access & Accounts
You must be at least the age of majority in your jurisdiction to use the Services. You may be asked to provide personal details such as name, email, shipping, billing, and payment information. You warrant that this information is accurate and that you have the right to provide it. You are responsible for safeguarding your account credentials and all activity under your account.
2. Products
We aim to present products accurately, but appearances (such as colour or texture) may vary due to device settings. We do not guarantee that products will meet your individual expectations. Product descriptions, availability, and pricing may be updated or withdrawn at any time without notice.
3. Orders
Placing an order constitutes an offer to purchase. Orders are accepted only once confirmed and payment is processed. We may decline or cancel orders at our discretion. If we do so, we will attempt to notify you using the details you provided. All purchases are subject to our Refund & Returns Policy. Orders must be for personal or household use only and not for resale.
4. Prices & Payments
Prices may change without notice. The price charged will be the one shown at checkout at the time of purchase. Unless otherwise stated, prices exclude delivery charges, customs duties, and any applicable taxes. We accept payments through Stripe, Tap Payments, Tabby, and Tamara. By providing payment information, you warrant that you are authorised to use the chosen payment method and agree to pay all charges in full.
5. Shipping & Delivery
Shipping and delivery times are estimates only. We are not responsible for delays caused by carriers, customs, weather conditions, or events beyond our control. Risk of loss and ownership of products pass to you once the order is handed to the carrier.
6. Intellectual Property
All content on the Services, including text, graphics, images, videos, logos, and trademarks, is the property of WEARON Clothing, its affiliates, or licensors. You may use the Services only for personal, non-commercial purposes. Unauthorised copying, reproduction, distribution, or use is strictly prohibited.
7. Third-Party Tools & Links
We may provide access to third-party tools or websites. These are provided “as is” without warranties. We are not responsible for the content, accuracy, or practices of third-party services. Accessing them is at your own risk.
8. Privacy & Data
We collect and process personal information in accordance with our Privacy Policy. Because our Services are hosted by Shopify, certain data may be processed outside the UAE. By using the Services, you consent to electronic communications, including service and transactional updates.
9. Buy Now, Pay Later (Tabby / Tamara)
When available, you may pay in instalments via Tabby or Tamara. Approval, repayment schedules, and late fees are managed directly by the BNPL provider. Your agreement with the BNPL provider is separate from your purchase agreement with WEARON Clothing.
10. Reviews & Feedback
By submitting reviews, suggestions, or other content, you grant us the right to use, reproduce, and display such content for business purposes. You warrant that your submissions do not infringe third-party rights or applicable law. We may remove or moderate submissions at our discretion.
11. Prohibited Uses
You may not use the Services to:
- Violate UAE laws or regulations;
- Infringe intellectual property rights;
- Transmit malware or harmful code;
- Harass, abuse, or defame others;
- Engage in fraudulent or deceptive practices;
- Interfere with or attempt to bypass security features.
We may suspend or terminate accounts for violations of these Terms.
12. Termination
We may suspend or terminate your access to the Services at any time without notice if we believe you have violated these Terms. Sections relating to intellectual property, liability, indemnification, and governing law will survive termination.
13. Disclaimers
The Services and products are provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted or error-free operation of the Services.
14. Limitation of Liability
To the extent permitted by UAE law, we shall not be liable for indirect, incidental, special, or consequential damages, including lost profits, data, or goodwill. Nothing in these Terms excludes liability where it cannot be limited under applicable UAE law.
15. Indemnification
You agree to indemnify and hold harmless WEARON Clothing (Kaelo Global LLC FZ), its officers, employees, affiliates, and service providers from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Services.
16. Governing Law & Disputes
These Terms and any disputes arising from them are governed by the laws of the United Arab Emirates. Any disputes shall be resolved exclusively by the Dubai Courts, unless mandatory law requires otherwise.
17. Changes to Terms
We may update these Terms from time to time. Continued use of the Services after updates constitutes acceptance of the revised Terms.
